Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, services,
products, and related offerings provided under the DigiTimber brand (collectively, the “Services”).
DigiTimber is a trade name (DBA) of Twitch Inc.
By accessing or using the Services, you agree to be bound by these Terms and our
Privacy Policy. If you do not agree, you may not use the Services.
If you are using the Services on behalf of an organization, you represent that you have authority to bind
that organization, and “you” refers to both you and the organization.
1. Definitions
- Account: A user account registered to access the Services.
- Customer: Any individual or entity that uses the Services.
- Billing Account: The account used for invoicing and payment.
- Payment Method: A valid payment method on file, such as a credit or debit card.
2. Eligibility and Registration
- The Services are not intended for use by individuals under the age of 13.
- You agree to provide accurate, current, and complete information and keep your Account information updated.
- You are responsible for safeguarding your Account credentials and all activity under your Account.
- You must promptly notify us of any unauthorized use or security breach.
- You may not impersonate another person or use offensive or misleading identifiers.
- We may suspend or terminate Accounts that violate these Terms or pose operational, legal, or security risk.
- You are responsible for maintaining a valid and accessible email address. Notices sent to the email on file are deemed delivered.
3. Services and Third-Party Programs
Certain Services may integrate or depend on third-party programs, platforms, or licensors.
For example, Microsoft New Customer Experience (NCE) offerings are governed by Microsoft’s own terms and policies,
which may change independently of DigiTimber. DigiTimber does not control and is not responsible for changes to third-party terms.
4. Billing, Payment, and Refunds
- Invoices are issued approximately 30 days prior to the service due date.
- Payment is due on or before the stated due date, regardless of invoice delivery or receipt.
- A late fee may be assessed beginning 3 days after the due date.
- Services may be suspended 4 days after the due date if payment is not received.
- Accounts may be terminated 10 days after the due date for non-payment.
- All Services operate on fixed billing cycles. Late payment does not extend or reset the billing term.
- Services paid for a single-month term are non-refundable.
- For prepaid terms longer than one month, any approved refund is issued as account credit only.
Credits have no cash value, are non-transferable, and may only be applied to future DigiTimber Services. - No prorated refunds are provided for unused portions of a billing cycle.
- Domain registrations are subject to registrar rules, are non-refundable, and require a minimum one-year term.
- Failure of an automatic payment due to an invalid or expired Payment Method constitutes non-payment.
5. Cancellation, Suspension, and Chargebacks
- You may cancel Services at any time by contacting support. Cancellation does not entitle you to a refund.
- Suspension or termination for non-payment does not pause the billing cycle.
- Reactivation restores access only for the remainder of the existing billing term.
- If a domain enters redemption or restoration status due to non-payment, all registry-imposed fees must be paid before restoration.
- You are responsible for backing up all data prior to cancellation or suspension.
- Chargebacks will result in immediate suspension and may incur:
- Pass-through of any Stripe or payment processor dispute fees
- An additional administrative fee of up to $45
6. Acceptable Use and Prohibited Activities
You may not use the Services for unlawful, abusive, or harmful purposes, including but not limited to:
- Illegal, fraudulent, or deceptive activities
- Infringement of intellectual property rights
- Spam, phishing, or malware distribution
- Activities that disrupt or degrade system performance
- Unauthorized scraping, automation, or reverse engineering
We may investigate suspected violations and take action as necessary to protect the Services, other customers,
and legal compliance.
7. System and Network Security
- Attempts to bypass security controls or access unauthorized systems are prohibited.
- We may cooperate with law enforcement regarding suspected security incidents.
- Maintenance, outages, or suspensions do not count toward uptime or service availability commitments.
- Shared or resource-limited Services are subject to reasonable usage thresholds.
8. Data, Backups, and Retention
- We may maintain backups for operational purposes but do not guarantee backup availability or completeness.
- You are solely responsible for maintaining independent backups of your data.
- We are not liable for data loss resulting from suspension, termination, or non-payment.
9. Privacy
We process personal information in accordance with our
Privacy Policy, which describes how we collect, use, and protect personal data.
These Terms and the Privacy Policy together form the complete agreement regarding privacy.
10. Indemnification
You agree to indemnify and hold harmless DigiTimber and Twitch Inc from any claims, damages, losses,
or expenses arising from your use of the Services or violation of these Terms.
11. Disclaimer and Limitation of Liability
- The Services are provided “as is” and “as available” without warranties of any kind.
- We disclaim all implied warranties, including merchantability and fitness for a particular purpose.
- To the maximum extent permitted by law, our total liability shall not exceed the amount paid by you
in the twelve (12) months preceding the claim. - We are not liable for indirect, incidental, consequential, or punitive damages.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
Any legal action must be brought exclusively in the state or federal courts located in Washington.
13. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised “Last updated” date.
Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
